Business Law Essay Example | Topics and Well Written Essays - 1000 words - 6

Business Law - Essay Example However, before any party can sue for enforcement of the contract, he or she has to show that there exist the six basic requisites present in a legally binding contract. Notably, an enforceable contract has to have an offer and acceptance, competent parties with a legal capacity to enter into a contract, a lawful subject, and consideration. In this case, Daffy will have to show the existence of the above mentioned elements in order to enforce the contract. According to the available details, Daffy will prevail in showing the existence of offer and acceptance and competent parties, but will fail to show the mutuality of obligation and the legality of subject matter. In order for a contract to be deemed enforceable, the parties in the contract must have a common intention or a meeting of the minds on the conditions of the contract. The individuals must come to an understanding on the same thing, in a similar sense at the same time. If a party to the contract has been deceitfully misled or deceived to accepting or entering into the contract, then the contract is voidable. In this case, Daffy knew that he had been stealing from the company and did not mention it to the company or the board of directors. Additionally, Daffy will fail to prove the legality of the subject matter if Acme can prove that Daffy has been stealing from the company in the high court. ... Stevenson (1932), a manufacturer is anticipated to exercise a reasonable duty of care to other people. In Donoghue v. Stevenson (1932), Donoghue, the plaintiff had taken a beer manufactured by Stevenson, which had remains of a slug at the bottom of the bottle. The court determined that there existed an implied contract between the manufacturer and the plaintiff and that the manufacturer ought to have the people affected by their actions in contemplation (Looney & Oliphant 56). For a negligent case to prevail, it is imperative for the party to show that the acts or blunders were the cause of the damage or harm suffered. In this case, Coyote will prevail in showing that the faulty switch caused the premature detonation and caused harm to him and his friend. This is actionable in a county of high court. For a case against negligence to prevail, there has to be a direct cause or factual causation. In Joe’s case, the court will have to determine what caused the car to skid and hit the tree. In this case, Joe will not prevail as the actual cause of the accident is the slippery pavement. If the pavement was not slippery, Joe would have responded to Coyote’s incident successfully. Additionally, his case will not hold water as he did not suffer any injury or damage (Looney & Oliphant 76). It is imperative for a party to exercise a reasonable duty of care to evade causing emotional distress to another party. In Bugs Bunny’s case, he suffered an injury as a result of emotional distress caused by witnessing the police accident. This case will prevail (Looney & Oliphant 78). In the third case, Foghorn Leghorn accepted the offer in writing but added additional terms to the contract. These terms were a precondition to the performance of the contract.

An Evil Cradling - Into the dark - use of language Essay Example for Free

An Evil Cradling Into the dark use of language Essay Throughout the chapter Into The Dark, Keenan goes through some distinct phases of mental states, each caused by a previous one and ultimately by his imprisonment. He uses a various range of strong descriptions to portray his condition, ideas, thoughts and impressions. The unusual syntax used throughout the chapter conveys the states of mind which he goes though, guiding the reader into the prisoners world. Keenan uses various techniques to convey the feeling of human degradation that he went through during the first period of his captivity. One of these is the enumeration of adjectives or nouns which communicate the misery to which he was reduced to. Such examples include the old, ragged, filthy cover which suggest the grimy circumstances in which he had to live in. The excrement, sweat, the perspiration emphasise this obloquy through which he goes. Sweat and perspiration imply oppressive heat, a sensation of lack of air. The excrement implies that in this already oppressive space, Keenan is reduced to sleeping in the smell of his own filth. This feeling is further emphasised by the quotation squat down over it. Defecate on it. I defecate ( ) and then I carefully wrap my excrement These short, blunt sentences imply that Keenan wants to describe his condition as close to reality as possible, therefore not sparing the reader from any brusque or less polite words, because he was not spared from any unpleasantness either. The enumerations suggest the plentiful reasons of his never ending human degradation and exposure to filth. Keenan described himself as a bag of flesh and scrape, a heap of offal tossed unwanted in the corner of this filthy room. This portrayal of himself, of flesh and heap of offal is dehumanizing as it reduces him to something repulsive and purely physical, thus overlooking the details that makes him human, such as feelings, mind and judgement. He is tossed in the corner, therefore not valuable for anyone. The fact that he is thrown in a filthy corner further emphasise his lack of value and significance. All these show how Keenans self esteem and dignity was crushed, and he as a person was reduced to nothing more than a worthless and abhorrent body. This conveys the extreme human degradation though which he goes. Keenans lack of stimuli and life are described throughout the chapter, which gives the reader and idea of the feeling of endless emptiness though which the hostages go. Referring to his urine and drinking water going From bottle to bottle, through me, this fluid will daily run, Keenan uses these endless cycles of life to symbolise the monotonous days of his captivity. The phase from bottle to bottle and though me suggest a continuous flow, while the word daily informs us of the length of one standard cycle. Keenan seems to live the same tedious days over and over again, making him feel lifeless and purposeless. The syntax of his writing implies dullness, repetition and lack of life as well. The phase No sound, no noise, nothing. Yet I try to force this scream. Why can I not scream? But no noise comes from me. Not even a faint echo of cry. I am full with nothing. is a very good example for this point. His sentences are very short, implying the lack of thing and stimuli to talk about. Why can I not scream? is almost a rhetoric question as he has no one to get an answer from. This highlights the lack of stuff to think about. And there are some sentences which are just an enumeration of words, like No sound, no noise, nothing. The repetition of no and nothing throughout this chapter father emphasise the lack of stimuli, as there are no objects, persons or phenomena to ponder about. In the end the narrator expresses his despair by confessing that he is full with nothing, implying his frantic need of something that he can think about, that can occupy his brain. Due to this prolonged lack of stimuli, Keenan becomes temporarily mentally unbalanced, with his senses going out of control.

Dramatic Irony in Shakespeares Romeo and Juliet Essay -- William Shak

Shakespeare uses irony to great effect in his many plays, specifically dramatic irony, and some cosmic irony, in the tragedy of Romeo and Juliet. But why does he use it? What is he trying to achieve or portray? It varies throughout the play, but there are general trends as the story develops. In the beginning we see that it is almost comical uses. The irony then develops into more interesting and intriguing uses meant to keep the audience, especially the groundlings, interested and wanting more. And then finally, he uses dramatic irony to point out some of the reasons why this is a tragedy during and before the climax. In the beginning you see irony without much apparent consequence, which can be seen as amusing in some views and helped to draw people in. Some examples of this would be Romeo and Juliet talks to each other and fall in ?love? before realizing that their parents apparently hate each other. Another example is when Juliet?s nurse comes to talk to Romeo about Juliet, and the friends of Romeo mock her thinking her another stranger. Both of these and other ironies in the opening acts are meant to be entertaining and to keep the groundlings happy, along with other factors, while at the same time setting the stage for the play to become a tragedy, and slowly starting to shift to a more depth as the play progresses. In the center, specifically act three you see the use of irony to be more serious, often trying to lightly foreshadow and keep the audience interested. From Tybalt aggravating Mercutio and then Romeo with his death, after Romeo seemingly feels and professes ?love? for him due to his very recent secret marriage to Tybalt?s cousin, Juliet. Shortly after Tybalt?s death Romeo is banished due to his, a... ...e party, to Romeo killing Tybalt right after marrying his cousin and talking about his love for Tybalt, to Laurence?s message about the plan being delayed due to a cruel twist of fate. Not only does Shakespeare use cosmic irony in this play, he makes the characters, especially Romeo again, put their faith in the gods who then appear to betray him with a list of unlucky coincidences that help lead to his downfall. The use of irony has a great effect on the plot and characters in Romeo and Juliet. Shakespeare managed to use dramatic irony for various purposes throughout the play that drastically help the build up of conflict, tension, and emotions. His use of cosmic irony after the protagonists put faith in fate adds a cruel twist into the story that helps to enrich the play and develop the characters. It is amazing how he manages to merge it all into the play.

Energy Conservation Mitigation Plan

Energy is one of the world’s greatest inventions of all time. We use energy on a daily basis for just about everything. Our way of life is based upon energy and how we use it. We use large amounts of energy for transportation and electricity. Due to the limited supply of resources available to us we need to make sure that we conserve them wisely so that these resources will be around for future generations. It is imperative that consumer start to take responsibility for their actions. There are two ways to conserve energy; one is by using energy efficient technologies and the other is by changing our habits. Individual efforts combined with governmental support will assist in decreasing energy usage which will in turn create a better environment for everyone. According to the EIA, the U. S energy consumption is 100 quadrillion btu/year and is projected to rise by 37 percent within the next 20 years. The U. S is also currently building 151 coal-fired electrical generating plants in order to keep up with the current demand (Holness, 2008). In 2003, 422 quads of energy were used in the world and 92 quads within the U. S alone. According to the report â€Å"Cutting Global Energy Demand Growth,† it is predicted that in the year 2020, the world will be at 613 quads. This report also states that by becoming energy efficient we can reduce this number to 478 quads in 2020 (Schirber, 2008). Some non living factors that contribute to energy consumption are the sun and the earth’s atmosphere. The sun produces large amounts of heat which creates heat. Humans tend to elude the heat by turning up their air conditioners. This increases energy use. Energy emissions that are released into the earth’s atmosphere can cause major health problem to humans and are very harmful to animals and plants. Living factors that contribute to energy consumption are plants and animals. If plants are affected by high energy consumption, than it will create a problem for the animals, which will than create a problem for the humans. The whole food chain could be distorted. Humans are the main living factor that contributes to energy consumption. We are dependent upon certain items such as fossil fuels for heat and energy. This is affecting our atmosphere causing problems for all types of living organisms. The greatest positive impact that energy conservation has is that natural resources will still be around for future generations if we start conserving now. Energy conservation will also have positive effects on our environment. It will also prevent health problems associated with burning fossil fuels and coal needed for energy. Humans also have a negative impact on energy usage. Most people do not realize the amount of energy they waste in any given day. Simple steps such as fixing lighting structures, planting trees around your house, and by driving less will help curve the energy abuse. All of these are very important steps in energy conservation. Leaving lights on when not in use is a negative impact on energy consumption. According to Laird (2009), people from all different occupations have been trying to find a way to better use our resources. For 20 years, our nation has been trying to come up with a plan to reach sustainability. The government is only a part of the equation. Everyone including innovators, government, firms, and nonprofit organizations need to come together. Simply put, they are not doing enough to make sure that energy sustainability is feasible for average consumers. Laird states that they need to create policies that are flexible and create institutions that can learn and change from mistakes. According to Laird (2009), â€Å"The level of funding, public and private, for renewable energy R&D is abysmally low, when seen in the context of the size of the energy market. † One of the most recent programs, Cash for Clunkers, was initiated by the government to assist individuals in buying more energy efficient vehicles. According to CARS (2009) over 700,000 clunkers were traded in for more fuel efficient vehicles in less than 30 days. My sustainability plan will primarily focus on citizens and what they can do to help conserve energy. I believe that in order to reduce energy consumption, we first need to start at the bottom which is in your homes. My plan will include researching the affects of energy abuse, educating citizens on how to conserve energy, plan meetings to distribute literature, and last but not least, showing citizens how they can help our environment and save them money as well. The first step in my sustainability plan is to do research to find out what basic steps can be taken at the consumer level to conserve energy. In the first two months I will gather all of the data necessary to present to citizens on how to conserve energy. In month two I will do informational surveys to see how many citizens are aware of the energy problem. This survey will also help me see how many people already are conserving energy in particular areas so that I can focus on areas that need more assistance. In month 3, I will than present the information to the citizens at a meeting. I will show them the following chart so that they can see how energy is consumed in the typical household. This chart will also assist me in showing residents where they can start making a difference at. This will show them areas they need to concentrate on in order to conserve energy and save them money. EIA. (2005). U. S household electricity report. Retrieved November 3, 2009, from www. eia. doe. gov I would make it imperative to the citizens to follow some basic guidelines in order to conserve energy. Some examples would be to use less wattage bulbs or even switch to fluorescent light bulbs that last ten times longer than other bulbs. Make sure you turn off lights when leaving a room. To cut energy on heating, residents can close curtains, lower thermostats, and seal out drafts. Some ways to conserve in the kitchen is to use adequate size pots and pans and turn down the flame if it is visible. Try not to preheat and use microwaves when feasible. If you have older appliances, replace them with newer, energy efficient appliances. Hang dry clothes when the weather permits. Other areas that you can improve energy consumption in are by lowering air conditioner temperatures. If you plant trees outside your home, it will create shade, making the temperature in your house cooler. I would end this meeting letting citizens know that they can always call their utility companies to come and do a home audit to show you how you can conserve energy. My final part of my plan would be to assist anyone who needed personal assistance with energy saving techniques. In this last month I would go to homes to see that they are doing their part in making sure they are conserving energy. If they needed help or additional information I would make that available to them. The biggest challenge in my plan is to show how purchasing these energy saving technologies is cost efficient to the buyers. Some people look at the initial cost and think that it is too high and don’t want to do anything about it. I would have to argue that some of the techniques are free and only require determination. Another challenge is gaining interest. I have to make sure that I get everyone involved. My goal would be to get one community started and then work on another community. I would need advocates to speak on behalf of energy conservation. The more people involved and committed to the plan, the better it will work. Benefits of my plan are obvious. We will not only be saving ourselves some money in the long run, but we will also be helping the environment out in a major way. We need to save our resources so that we have enough to last us a life time. Not to mention, we will be cutting down on pollution which is another environmental problem. In order to make a difference in our communities, we need support from not only the residents, but from the government as well. The government needs to step up and start mandating that certain codes are in effect on buildings. One successful program available to consumers and business is the ENERGY STAR Program. This program enables Americans to purchase products that saves them money and helps the environment. â€Å" In 2008, Americans with the help of ENERGY STAR, saved enough energy in 2008 alone to avoid greenhouse gas emissions equivalent to those from 29 million cars — all while saving $19 billion on their utility bills† (ENERGY STAR, n. d. ). ENERGY STAR is a program of the U. S. Environmental Protection Agency and the U. S. Department of Energy. Their mission is to help us all save money and protect the environment by offering energy efficient products. More programs such as this need to be implemented in order to achieve our goal. We need to conserve energy to save money, especially in a struggling economy. The best part about doing this is that we are also doing something for our environment. Implementing plans to lower energy consumption is a difficult task, but not a task that is unachievable. Our nation cannot afford to waste natural resources that are rapidly diminishing. We need to change our way of life to conserve what the Earth has given us. Our Earth can no longer tolerate the misuse of energy if we want it to be around for many generations to come. Energy conservation is essential due to the limited supply of natural resources. Jenny Powers of NRDC states â€Å"The cheapest, cleanest energy is the energy you don’t use. † Let’s help break the cycle. As citizens we need to do our part by embracing an energy efficient lifestyle and slow down our demand for more electricity. References CARS. (2009). Cars allowance rebate system. Claudio Monteverdi Essay Example

Claudio Monteverdi Essay Example Claudio Monteverdi Paper Claudio Monteverdi Paper Monteverdi letters do provide great insight into his life, but the fact remains that the most important biographical documents and dates are missing (Redline, 1-2). Even information on his ancestors and immediate family is sparse because most of them are unknown, the exact dates of his father and mothers birth and death are even unknown (Redline, 2-3). The most startling secret of Monteverdi existence Is that his body Is lost; his remains are known to be In a public tomb of the Chapel of Santa Imbroglio In the del Frail Church, but no one can Identify his remains from the remains of all the other people that were put to rest there (Moldier, 386). While much of Monteverdi biographical information may be lost, his letters and influential music provide a wealth of information on his life (Redline, Examine). Monteverdi life is known to have begun in Ceremony, Italy, but the exact date of the birth is not known (Examine, 117-118; Redline, 4). His birth has been established to be in the early part of May 1 567, and the baptismal records at the Church of S. Nazarene and S. Cells in Ceremony confirm this time. The church records reveal Monteverdi birth date to be May 15, 1567 (Redline, 4). While the Church register of baptisms does provide a birth date for Monteverdi, it also creates confusion about the spelling of Claudio last name (Raddled, 4). The church records provide the spelling Monteverdi, which contradicts the spelling: Monteverdi that Is present on all of the Orlando 121 letters (Raddled, 4). The confusion about the name Is completed by the spelling that is in printed collective editions of his works, which reads Monteverdi (Redline, 4). The spelling Monteverdi takes precedence because Claudio as known to have not overseen all the printed editions (Redline, 4). While Monteverdi name and life was a confusing composition of secrets, his familys lives were not any more revealing. Monteverdi was the first born of five children, and biographers only mention one of the siblings, Gigolo Cesar, as having any significant presence in his life (Redline, 3). Monteverdi was probably the closest with his brother that was six years younger than him because they shared the ambition to have musical careers (Redline, 3). Cesar first appeared In 1607 as the publisher of Monteverdi Scherzo Musical and as the tutor of the Deliberation, which was strongly Influenced by Monteverdi (Raddled, 3). The relationship between Monteverdi and Cesar Is Implied to be a happy one, which can be illustrated by Monteverdi inclusion of two small original compositions of Curares In Nils volume AT ten scenery Cesar neon an organs post In Castellated, and he was later Maestro did Chapel at Solo Cathedral in 1612 (Redline, 3-4). He seems to have had an intimate relationship with Monteverdi during the Mutant period of Claudio life, yet he is not mentioned after the year 1612. His arenas are completely different in the amount of information that is known about them; his mothers maiden name and Christian name are unknown, and she is mentioned very little in any sources on the topic of Monteverdi life (Redline, 1-2). Ballades, Monteverdi father, is much more evident in Claudio life (Redline, 3); Ballades was a doctor, which provided his family with a comfortable lifestyle and his children with a classical education under the best teachers (Redline, 3). The teacher that Ballades chose for his sons (Claudio Monteverdi) musical education was Marc Antonio Engineering; Ballades was a cultured man with the means o provide the best for his son (Redline, 4). Engineering was without a doubt the most important musician within the boundaries of Ceremony (Redline, 4). Claudio was a pupil of Engineers for ten years, which can be illustrated by Monteverdi mention of him on the title-pages of Monteverdi compositions during that time period, 1580-1590 (Redline, 5). There was a three-year gap between Monteverdi books of madrigals at that time, but the sub-title of the later publication that mentions Engineering implies that the master and pupil were together (Redline, 5). Under the audience of Engineering, Claudio composed Continually at the age of fifteen; the work showed the pupils complete understanding of the three-part vocal writing style (Redline, 5). Monteverdi was an oddity in that he had already published four diverse works: tracing, sacred madrigals, contrasts, and secular madrigals before he was twenty years old; this musical foundation was laid by his master, Engineering (Redline, 5). The first time that Engineers name is absent from the title-page is in 1590 when Monteverdi dedicates a book of madrigals to his new master, the Duke of Mantra; his is the last time Engineers name is mentioned in accordance with Monteverdi (Redline, 6). Monteverdi career at the Court of Mantra began in 1590, but he on probation during this year (Redline, 6). He was only accepted for a permanent position at the beginning of 1591 (Redline, 6); he was hired as a singer and violist (Examine, 117-118). He served there for 21 years (Examine, 117-118), and during this time he was promoted to Cantors, which is basically a music director (Redline, 9). During Monteverdi career at Mantra he created many great works, including his and Mantas first opera, Refer (Shards, 224-225). The opera was performed in 1607, and it was a lavish production (Examine, 119-120). Refer contained star soloists, a chorus, dancers, and a large orchestra of about forty players; the lavish setting of the opera was mostly per request of Monteverdi master (Examine, 119-120). Monteverdi master, Vincent I Conga, was an important part of his life; he was the one that promoted Monteverdi in 1592 (Redline, 6,9), and he was the one that gave approval to Monteverdi choice of bride (Redline, 9). Claudio new wife was Claudia Castanet, the daughter of Monteverdi violist colleague, was a professional singer (Redline, 9). The two were married in the later part of 1594 or early in 1595, while Monteverdi was still serving at the Mutant Court (Redline, 9). The couple had two sons during their twelve-year marriage, but they also struggled Dialectally (Really, 1 I en years AT Atlanta trouble spanned Trot to 1607, which was also a time of illness for Claudia (Redline, 15). The Monteverdi family moved to Ceremony to live with Ballades, Monteverdi father, who cared for Claudia (Redline, 15). The stress from their debts caused Claudia health condition to worsen, and she died on September 10, 1607 (Redline, 15). She left Claudio a widower t the age of forty (Redline, 39-40) and with two sons: ages seven and two (Redline, 15). After Claudio and Claudia short marriage and her death, Monteverdi went into a time of oblivion and chastity (Redline, 42-43; Mainliner, 388). Monteverdi may have not known it during that time of pain for him, but he would be musically active again. He would be considered the bridge between two musical periods (Redline, 35). Monteverdi comprised both the Early Baroque and Venetian periods; he was able to live through the crossover between the two periods (Redline, 35). Each musical period had a part in shaping Monteverdi career. Works of the Baroque period (1600-1750) were known to be extremely emotional; it was a time of lavish and dramatic proportions, especially in music (Examine, 98). The best Baroque music is from the later part of the period, but the early period composers were the most revolutionary; this is the category Monteverdi fit into (Examine, 98). In Italy, especially, music was created or composed with texts that conveyed ultimate emotion; the text was the most prominent part of the music (Examine, 98). These reasons led to the creation of opera. Opera was conceived in Italy from the discussions of the Camera, small group of nobles, poets, composers, and other artists who began to meet regularly in Florence in 1575 (Examine, 116). The Camera wanted to create a new vocal style based on music of ancient Greek tragedies; it was designed to be midway between melody and speech (Examine, 116). While Monteverdi was not a member of the Camera, his first opera, Refer, followed the ideal the group had set up for opera (Mainliner, 393). Monteverdi, like other Early Baroque composers, preferred homophobic texture because he felt the words could be projected more clearly with one main melody and only a choral accompaniment (Examine, 98). Most of the Baroque opera was composed for ceremonial occasions at court and was designed as a display of magnificence and splendor (Examine, 116-117). Monteverdi operas and productions at the Court of Mantra are a perfect illustration of this Baroque period characteristic. The subject matter of the Baroque operas was Greek mythology and ancient history; the aristocratic patrons loved the classical civilizations of Greece and Rome and related to the Greek and Roman divinities and heroes (Examine, 116-117). Monteverdi went along with these ideals because he knew that while opera was a retentive expression, it was also a way to flatter and gain the acceptance of aristocracy (Examine, 1 17). While Monteverdi appreciated the ways of aristocracy as a way to gain success musically, he had a growing discomfort with the courts of princes and an increasing skepticism towards aristocratic methods of business (Redline, 44). These feeling became more apparent during Monteverdi Venetian period in his later years, which stems from his sudden and inhumane dismissal from the Mutant Court (Redline, 44). Monteverdi master at Mantra, Vincent l, died and left his heir, Francesco V, who dismissed Monteverdi without cause (Redline, 44). Even though Monteverdi felt negatively towards some aspects of his society, he was mostly unaffected by them (Mainliner, 393). He was more concerned with creating music of emotional Intense TTY en 010 not care auto skeletal or religious motives Duty simply artistic ones (Examine, 118-119). Monteverdi aspirations in the musical world were simply to create the highest degree of expressionism; he did not want to create new forms, he did not want to please nobles, and he did not want to gain spiritual enlightenment (Mainliner, 393). Even though these were not Monteverdi goals, he still attained them in some way. His relation to religion is the most ironic; he did not seem to be a spiritual man, yet much of the success of his career is based on religious positions he held and spiritual music he created (Mainliner, 392-395). The time period that Monteverdi lived in was the cause of most of his religious works and posts; the earlier portion of Monteverdi lifetime made spiritual music and musicians dominant (Redline, 46-47). Official musical posts were controlled exclusively by ecclesiastical appointments; Monteverdi appointment as Maestro did Chapel did San Marco outweighed any secular post (Redline, 46, 47, 48). He held this position at SST. Marks Church in Venice from 1613 until his death, thirty years (Examine, 118). Even in Monteverdi younger years of composition and training, many of his published works were dedicated to Ceremonies clergy and nobles (Redline, 5). Monteverdi relationship to the church seemed purely traditional (Redline, 43-44), but he was actually Just doing what was necessary to get his music heard (Shards, 247-248). This can be proven by the fact that Monteverdi did not compose sacred or elisions music until he was ordered to compose it by his master at the Court of Mantra in 1601 (Shards, 247-248). It was twenty-eight years before he published new sacred music, but his secular or nonreligious music was published regularly (Shards, 247-248). While he did not seem to enjoy his religious works, they, such as: the Miss and Vespers are considered to be some of his greatest compositions (Redline, 146-147). Claudio was also known to change the words of his secular works to make them into religious works that he was required by his society and his posts to create (Mainliner, 393-394). It is obvious that Monteverdi felt constrained by the religious requirements of his era, but change slowly occurred throughout Monteverdi lifetime. Music and the career of the musician changed slowly but drastically during Monteverdi life (1547-1643); colonization became more acceptable (Redline, 46-47). Even though Monteverdi was required to compose religious music, he was able to create secular music on the side (Examine, 118). Europe, especially Italy, became more of an artistic center; music became even more important for political functions for aristocracy (Redline, 46-47). While it was not Monteverdi intention to create new musical ideals and concepts in his works, he did manage to revolutionize music in many ways (Redline, 39). Monteverdi most dominant purpose in creating music was expressionism; he wanted to illustrate human nature through an artistic dramatic work (Shards, 226-227). He did not view musical forms as permanent or unalterable schemes or patterns for him to follow; Monteverdi used them as a guideline and altered them to achieve the dramatic effect he desired (Shards, 227). He compromised his mix of form and improvisation with the terms: Prima Practice and Seconds Practice (Redline, 117). Prima Practice accepted the art of polyphonic composing, and it made the music and words equally important (Redline, 117). Seconds Practice was extremely emotional; it is when the words climax with elemental force (Redline, 117). Monteverdi wanted to extend the previous range of emotions to Include gloating, excitement, Ana passion (Kamala, 1 achieved this intensity in his music by using more dissonance than ever before, and he would use new orchestral effects like pizzicato and tremolo to create angry and war-like feelings in some of his texts (Examine, 119). Claudio other musical achievements were: the discovery of orchestral color, which is blending the vocal and instrumental tones or timbres into a unique combination of sounds; his evolution of chromatics for expressionistic reasons; and the coining of characteristic types of motive (Redline, 39). Monteverdi music never followed the same pattern and was unpredictable; he was experimental enough to be considered revolutionary and traditional enough to be appreciated by society (Mainliner, 388). In the last phase of Monteverdi life during his Venetian period, he did not settle own as most composers of his time did (Redline, 37). He was very active musically; he published The Eighth Book of Madrigals in 1638 and Selves Morale e Spirituals in 1640 (Redline, 37). It is also during his older years that Monteverdi started to commission music again; he was seventy-four when he gave operas to the public opera houses (Redline, 48). Monteverdi even wrote for the first public opera house in Europe, San Casino (Examine, 118); it opened in Venice in 1637 (Redline, 48). Only a short time later, Monteverdi wrote his last opera: Oleomargarine did Poppa (Examine, 18). Monteverdi, along with other Early Baroque composers, was greatly forgotten until the 20th century with the invention of long playing records (Examine, 98). Even with the invention of records, only three of Monteverdi twelve operas are preserved and can be heard (Examine, 1 19). One of the remaining operas that can be listened to is Refer, which is the first opera ever written by Monteverdi (Examine, 119). It is also the first operatic masterpiece to be written by a professional musician (Examine, 117). Refer was composed in 1607 for the Mutant Court, and it was an ornate and lavish production (Examine 119-120). The story of the opera is one of Greek mythology, which is fitting because it was composed for Monteverdi aristocratic court that enjoyed the stories of Greek mythology and related to the characters (Examine 119-120). The myth and opera is about the very gifted musician Orpheus, the son of the god Apollo (Examine, 119-120). Orpheus is very happy after his marriage to Eurydice, but he is extremely depressed when he discovers the death of his new bride due to a poisonous snakebite (Examine, 119-120). Orpheus goes to the underworld or Hades to try and bring Eurydice back, which he able to do because of his musical talent (Examine, 119-120). Orpheus can bring her back to the world on the one condition that he cannot look back at Eurydice as he guides her out of Hades. In a moment of hesitation, Orpheus looks back at her, and she vanishes (Examine, 119-120). The opera ends with Apollo pitying Orpheus and allowing him to remain in Heaven eternally where he can gaze on Eurydice radiance in the sun and stars The specific movement that I feel encapsulates Monteverdi (Gamete, 119-120). Sino for expressionism and drama is in Act II; it is called Tu SE Mortar (Examine, 120). The translation of the title is: Mimi are Dead, which is what Orpheus is so intensely singing after the discovery of Eurydice death. This song is haunting because of its text, and its slow tempo and singular accompaniment. It seems as if Orpheus is all alone mourning the loss of his bride; it is a very intimate moment in the opera that made me feel uncomfortable as I listened to it, as if I should not have Eden listening In on tens mans private Ana sorrows LU moment. Scenically, LU SE Mortar is brilliant; it has a vocal line that is rhythmically free with barely any sense of beat or meter, and its phrases are irregular in length (Examine, These aspects of the song make Orpheus pain seem real; the odd rhythm, beat, meter, and phrase length make it sound as if Orpheus cannot contain his grief. This makes the song sound as if it were perfect at one time, technically, and now it is overcome with the pain of a lost love, so it is slightly off and does not sound completely correct or resolved. The songs oddities may also symbolize Orpheus life without Eurydice, which is now slightly off and does not seem to be correct. Monteverdi mastery of the past novelty of recitative is seen in Tu SE Mortar; the flexible setting of the text is meant to suggest the passionate speech of an actor declaiming his lines (Examine, 120-121). I definitely felt Orpheus passion as he sang the recitative, which provided the important information. The aria climaxed after the recitative, which made it even more powerful. I especially appreciated how Monteverdi made the word mortar very low, quiet, and eerie. It was as if Orpheus was whispering to Eurydice that she was dead, and Orpheus would then spiral into the aria, which I think symbolized his rage at the realization that his wife was actually dead. The song also involves lines about Orpheus bringing Eurydice back from the dead; these lines are also very loud and powerful. I think Monteverdi made these lines loud and extreme to show how determined Orpheus was to have his wife back. When Orpheus sings these lines, l will bring you back to me to see the stars again it is like he is singing to Eurydice like she is still alive.

Essay on BrandingEssay Writing Service

Essay on BrandingEssay Writing Service Essay on Branding Essay on BrandingThe contemporary business environment stimulate companies to conduct more aggressive business strategies oriented on the creation of the attractive brand, while branding has become a part of the marketing strategy of many companies. In actuality, companies cannot ignore their branding policy, if they want to maintain a successful competitive position because customers often view brand as the determinant factor that influences their decisions. As a result, the brand popularity can determine the overall success of the company in the market. At this point, it is possible to refer to the case of Natural Kitchen, the company operating in restaurant and food industry. At the moment, the company considers the possibility of the accelerated brand development to enhance its competitive position and attract new customers. The shift toward the intensive implementation of the new branding strategy has become the result of tightening competition in the industry and increased dema nds from the part of customers, who look for reputable and reliable brands. In such a situation, the creation of the popular and attractive brand by Natural Kitchen can put the company in an advantageous position compared to its rivals. This is why Natural Kitchen should focus on the further development of its branding strategy and create a popular and attractive brand to maintain its competitive position through the attraction of customers and developing their loyalty to the brand. Background and industry contextNatural Kitchen is the company operating in the food and restaurant industry. Natural Kitchen has the main shop in Marylebone High Street, with a further two in Holborn Tower Hill. In addition, the company has its cafà © and restaurant business. The company focuses on the development of its food â€Å"to go† or â€Å"eat in† which offer a large selection of seasonal salads, quiches, soups, sandwiches, cakes and sweets, etc. These are complemented by freshly m ade juices, smoothies, milkshakes, teas coffees. The company also offers catering which provides full catering and events services as well as personal catering. Moreover, the company has its own chef and butchers which sell a wide range of high quality free range organic meats. In such a way, the company focuses on the diversification of its products offering a variety of food products that are attractive for customers. The current situation in the market is quite challenging for the business development of Natural Kitchen but still the company has good opportunities for the further business development on the condition of keeping customers interested in the brand of the company and its products (Mohrman, 2008). Today, customers are interested in healthy food products and Natural Kitchen can offer them such products. However, supplying healthy products means that they have to be seasonal wherever possible. Moreover, they should be organic that means that they should be supplied by farmers, who implement the organic farming which does not admit the use of chemicals and other elements which may be dangerous for the environment or human health. Instead, they use natural elements only that makes their products organic and, therefore, healthy, safe, and environment friendly.Another trend in the food industry is the free range of products. The elimination of fiscal barriers stimulates the fast development of free trade internationally. As a result, new products enter the UK food market and customers have virtually no limits on purchasing any product which they want and can buy in the food market today. At the same time, the quality of food products becomes prior to their quantity because customers grow more and more concerned about their health that means that the food they eat should be healthy too. In such a situation, the food industry faces back to basics trends, when the industry returns back towards simpler food. Alternatively, some companies introduce  "new† superfoods which are supposed to be safe and healthy.CompetitorsAt the moment, the competition in the food industry of the UK grows tighter because customers grow more and more concerned about their health, while food is crucial for the health of customers. As a result, they prefer healthy food to conventional food supplied by the industrial farming and companies selling those products. In such a situation, Natural Kitchen and its rivals take a very prospective and attractive niche in the food market. To meet the growing demand, many companies enter the healthy food market that tightens the competition in the industry. In actuality, Daylesford Organic is one of the major rivals of Natural Kitchen. The company operates successfully and holds a strong position in the UK market being of the major powers that threaten to the position of Natural Kitchen as the leader of the organic, healthy food industry. At the same time, other healthy take-away places also create a strong r ivalry which Natural Kitchen has to deal with to maintain its successful marketing performance.Rationale for the brand’s evolutionIn the time of the tightening competition and new business opportunities, the company has to develop its brand and implement its aggressive, new branding policy to realize its full potential and take a stronger position in the highly competitive market. In such a situation, the brand evolution is essential to maintain the successful business development of Natural Kitchen. Otherwise, the company will steadily lose its position in the market and eventually the company may become unable to compete successfully, if it fails to enhance its brand over and over again. At the moment the company faces a number of threats, among which the emergence of many healthy alternatives is one of the main challenges to the current position of Natural Kitchen that requires the evolution of its brand and enhancement of its position in the market. In addition, the compan y faces internal problems. For instance, the Cafà © Restaurant is very noisy from the â€Å"kitchen†. Therefore, customers feel uncomfortable because the noise from the kitchen interferes into the communication and makes them feel tired soon, when they enter the Cafà © Restaurant. Furthermore, the Cafà © Restaurant should be at the same floor to create a better atmosphere. The creation of a warm, family-like atmosphere can help the company to attract more customers and develop the customer loyalty, if the company creates the image of the cafà © restaurant that is oriented on families. Therefore, children will develop the tradition of attending the cafà © and restaurant and may continue attending it in their adult life. Another problem the company faces at the moment is no hot food to takeaway. In such a way, customers, who may be willing to buy hot food to takeaway, may feel disappointed because the company cannot offer such products at the moment. In fact, the compa ny has to stand out and differentiate its products and services from those of rivals and branding can help the company to create the new public image of the company that may attract more customers. In actuality, the company has a number of opportunities, which the new brand strategy can help to implement and give the company a strategic competitive advantage. At the moment, the company can expand in the UK nationwide to become one of the leaders in the industry. In a long-run perspective, the company can expand to other countries and operate internationally. In this regard, the popularity of healthy food grows stronger and the company can take advantage and expand its business internationally. In addition, the company can complete the transition from sell groceries to luxury supermarket, take a new niche of the market and entering the premium segment of the market. The company can develop the daily meal delivery to attract more customers and increase the customer satisfaction. Howeve r, to conduct the branding evolution more successfully, the company should develop more advertisement and use advertisement to promote the new brand. The advertisement will attract more customers and help the company to enhance its position in the market. Moreover, the advertisement will help Natural Kitchen to create a recognizable brand.Essay on Branding part 2

International Development of Cricket - Essay Example At present, cricket is the only game, which has laws other than rules, which covers the specific size or weight of pitch, crease, wicket, and ball. First and last occurrence of cricket in Olympic was in the year 1900 and the match was between France and Britain. After a long time the renewed interest is boosting up to again introduce cricket in the Olympic Games. In the year 1909, ICC was formed with founder nations like England, South Africa and Australia. ICC was previously known as Imperial Cricket Conference but later changed into, the International Cricket Conference. The abridged version of cricket was introduced in the 1960’s, which is more commonly known as, one-day cricket. The one-day cricket gained its popularity due to globalization and as the format is quite shorter than the usual test cricket The successes of one-day matches in increasing global viewership, helped ICC to figure out the ‘Cricket World Cup’. During the last 60 years, the interest of pl aying cricket among the new countries has doubled in numbers and countries like India, Pakistan, New Zealand, Sri Lanka and Zimbabwe are new entrants in this league. Out of these countries some of the countries took cricket professionally and some of them accepted it non-professionally without any cricketing facilities. Discuss the treatment of the sacrament of confession in Essay

Discuss the treatment of the sacrament of confession in Boccaccioâ‚ ¬Ã¢â€ž ¢s tale of Ser Ciappelletto, The Summoning of Everyman, and Hesseâ‚ ¬Ã¢â€ž ¢s Narcissus and Goldmund - Essay Example In the spirit of a culture beginning to question the superficiality of dogma, Boccaccio transcends the cynical humor of Ciappelletto’s confession, and the friar’s absolution, reminding us that there is a divine immanence beyond and above the temporal, sometimes absurd practices of the medieval church. After Ciappelletto’s false confession, the narration muses that he may have, at the last, received forgiveness for his many sins, having â€Å"made so complete an act of contrition that perchance God had mercy on him†¦Ã¢â‚¬ (Boccaccio 89). But considering the evidence of his transgressions, eternal punishment is a much more likely fate. In other words, he may have fooled the friar and ultimately received canonization, but true justice is another matter Saint or no, Ciappelletto faces a verdict from which he cannot escape through bluff and deception. It is not given to us to know the final disposition of Ciappelletto’s soul but if eternal damnation is his lot, then it is a â€Å" manifest token of the superabundance of the goodness of God to usward, inasmuch as he regards not our error but the sincerity of our faith, and hearkens unto us when, mistaking one who is at enmity with Him for a friend, we have recourse to him, as to one holy indeed, as our intercessor for His grace† (Boccaccio 90). Confession has enabled Ciappelletto to â€Å"work the system,† to play on notions of holiness, seen through the prism of a worldly church, in order to receive absolution and achieve sainthood. His confession typifies the comparative spiritual impotency of the medieval church, itself a wan reflection of the true spirit it purports to embody. Flouting the sacrament, he has effectively lied his way to sainthood. But Boccaccio assures us that, for all his fabrications, Ciappelletto’s punishment surely must be all the worse in the next world for having â€Å"gotten away with it† in this

Stop Online Piracy Act (SOPA) Research Paper Example | Topics and Well Written Essays - 1250 words

Stop Online Piracy Act (SOPA) - Research Paper Example Requirements consist of the applicant of court orders to ban advertising systems and payment services from carrying out business with the offending websites and search engines links to sites, and court orders demanding suppliers on the Internet to disallow accessing sites. The bill would expand the criminal law to consist of the unauthorized transmission of copyrighted material, setting a maximum penalty of 5 years imprisonment2. The bill has grave implications for the current structure of the Internet in every sense as it allows the Justice Department and the owners of intellectual property, obtain court orders against those sites or services that allow or facilitate the infringement of alleged copyright, including: Block by ISPs to the website or service in question, including hosting, and even DNS level (although this has been a discussion). Facilitate collection companies on the internet (like PayPal) to freeze funds and restrict the use of the service. Block the sites that provi de advertising services. For example, Google Adsense cannot offer web service complained if this law was to be approved. It should remove links to the web or service reported. The bill declares a criminal offense to unauthorized radio broadcast or other distribution of copyrighted content with the punishing of the guilty with the maximum penalty of imprisonment for a term of 5 years. ... Under the bill, any member of a network on the Internet – from service providers, search engines and even the advertisers – in fact, require treatment for any owner to stop providing services to the resource, accused of piracy, and to stop any interaction with them (for example, close the channel, pay for content, suspend the ad contract, to limit the effect of the payment system, delete the site from Google to remove links to the site, completely block a site to visit, to prohibit the payment systems (such as PayPal, Visa, etc.) to make payments in favor of services and so on); otherwise, any of the direct and indirect accused of counterparties site will be regarded as his partner. Under the eyes of this new law, merely to get on your wall a picture, document or video that has a copyright will be considered a crime. This bill was welcomed by the entertainment industry in the United States and members of both parties. The funny thing is that this kind of activity is man y times promoted by the entertainment industry itself since they are the same fans who virally promote their favorite artists through social networks. Supporters of the bill argue that it is necessary to maintain profit organizations, employment and intellectual property protection in their respective industries (movies, music, software, etc.), especially states that it will help deal effectively with services outside the U.S. outside their jurisdiction. According to them it provides a protection to the market for intellectual property, employment and income, and need to strengthen enforcement of copyright laws, especially against foreign Web sites. Alleging defects in existing laws do not include foreign sites owned and functioned, and cited examples of "active promotion of the websites

Fundamental Reasons For Lobbyist Reform Term Paper

Fundamental Reasons For Lobbyist Reform - Term Paper Example TBTF banks, GM, Chrysler, AIG, and other important American companies received aid from the Treasury in the form of stimulus money intended to address the root causes of the problem in losses stemming from the real estate melt-down. After review, it is believed that the undue lobbyist interest by the same companies that received financing from these programs, as well as from the Federal Reserve directly via Quantitative Easing, may have influenced or even corrupted the process through which legislation was written concerning their own industry. Furthermore, the same influences were also seen during the process during which the Health Care Reform was passed. These issues point to a larger cause in the need for lobbyist reform. The most fundamental reason for this is to remove the possible conflict of interest in legislation, but this issue may also be seen as protecting the greater democratic system as well as making the administration’s own work more effective in legislation and reform. 1. In the examples of the Wall St. Rescue Package, TARP, and the stimulus packages implemented to assist the economy, Time magazine reported, â€Å"the legislation, which would bring more change to Wall Street than anything else enacted since the New Deal, was a Super Bowl for lobbyists.† (Brill, 2010) In analyzing the way that lobbyists from Goldman Sachs, J.P. Morgan, Bank of America, Citi, and other TBTF banks contributed soft money to the political process to buy influence in legislation, it reflects badly on the Administration and democratic process in America, and through this, encourages the Administration to support reform of lobbyists in Washington. 2. In the example of Financial Sector reform, the same companies and others, including major leaders in the industry, finance, and banking have influenced the process unduly.

Export-Led Growth Theory Essay Example | Topics and Well Written Essays - 1250 words

Export-Led Growth Theory - Essay Example However, this is not always the case for most domestic markets since governments may seek to protect blossoming industries to ensure their growth and capacity to exploit their potential comparative advantage (Liebler & Ward 1992, p. 339). Notably, export-led growth is prevalent in a majority of developing country, but the theory does not always guarantee success in the long term. This paper will examine the successfulness of the export-led growth model, taking into consideration a predominantly export-oriented country such as China to demonstrate how export-led orientation is not always effective in ensuring growth. In the adoption of export-led economic systems, governments often have to institute a number of measures such as tariff reduction, establishment of a floating exchange rate, especially through the devaluation of the national currency to enhance exports and government assistance for exportation industries and sectors (Liebler & Ward 1992, p. 338). The purpose of export-led strategy is to discover a niche market in the global economy for a country’s exports. Export-led growth has long been touted as a way of enhancing economic growth and maturity. Nations such as South Korea, Taiwan and China had implemented successful export-led growth strategies. However, global economic recessions such as the one witnessed between 2007 and 2010 have cast doubts on the success of export-led growth because of its emphasis on the specialised, internationally based economy, which is susceptible to global changes in demand trends. According to Yang (2008, p. 3) the term export-led growth refers to the successful growth episodes characterised by growth in a country’s export. Yang (2008, p. 3), however, poises that if export-led growth was the real justification for episodes of high growth in GDP and exports, then countries that adopted the system should have experienced appreciation in real exchange rates. This incident is primarily as a result on influx in foreign exchange as a consequence of the booming exports. However, this is not the case since only about half of the export-led growth episodes are characterised by exchange rate appreciation. In most instances, export-led growth is unsuccessful since it results in the depreciation of countries’ exchange rates; hence the conclusion that the high export growth is not ideally safe growth for a country. In essence, the export-led growth theory is not the overriding force for growth episodes categorized as high export growth since the non-tradable sector also plays a critical role in eliciting high economic, as well as export growth. China continues to experience massive structural imbalance issues as a consequence of adopting an export-led economic strategy in earlier years (Yang 2008, p. 5). Although the country boosts of high rates of economic growth, its imbalance problems continue to wreck havoc to the viability of its economic stance on the long term. The imbalance problem s are deeply rooted in the country’s double transition, and will only ease when the nation completes its final transition in the next two decades, which is quite a long period. Meanwhile, the imbalances caused by the implementation of an export-led economy may result in severe political and social unrest, which may impede China’s growth trajectory. On the other hand, export-led growth is not successful since it subjects a country’s economy to undue exposure to the international world. By definition, an

Adversarial system of justice Essay Example | Topics and Well Written Essays - 500 words

Adversarial system of justice - Essay Example Adversarial system of justice We can argue that Gideon V. Wainwright lost his case in 1963 because he lacked the funds to hire a lawyer to prepare his defense. This was after he requested the court to appoint a lawyer for him which the court refused. He defended himself in the trial and got convicted by a jury leading the court to sentence him to five years in a state prison (Fridell 69). It gets speculated that the state court’s lack of assigning Gideon a counsel violated his right to a fair trial. This clearly shows that this system is adversarial in name only. Question is, does a system that places value on winning encourage manipulation and deception? The clear answer to this indicates vividly if this system of justice is losing or gaining. This system is full of deception because the law gets highly manipulated to favor the side that can argue best. We are losing more because truth and justice do not play a role in its operation. Winning and losing is the main goal of the adversarial judicial system (McBride 94). It is a game of words where every side attempts to discredit the other’s witnesses and evidence. Lawyers get obligated to challenge the evidence against their clients even if it means impugning the police. They even attack a victim’s or witness’s character. Any judicial system should ensure justice. The adversarial judicial system is increasingly leading to injustice because lawyers bargain for less punishment or no punishment at all for even those that are guilty. This means that more and more people are suffering injustice with this system.

The industry leaders are Coca-Cola and Pepsi. This industry is unique in the sense that the product is bought primarily for the brand image of the company rather that the utility of the product. The purpose of a carbonated drink can well be served by a glass of water or lemonade. The companies strive to capture market share through extensive advertising and branding. The carbonated drinks were perceived as a health concern so the companies introduced non carbonated drinks like juices. The firms in this industry exercise tight control over the suppliers and compete on price to get customers. The industry is very competitive and makes it very difficult for a small player to exist. The bigger firms have an advantage due to economies of scale. Introduction Soft drink industry has been a successful growth for a long time. In recent years, the sales of basic soft drinks have been depreciated highly due to increment of health awareness, change in consumer behaviour towards other varieties of soft drinks etc. But all over the changes have been directed net positive increment in sales due affinity of consumers towards juice and bottled drinking and mineral water. The big players of original soft drinks like Coke, Pepsico etc. are acquiring or diversifying their products toward juice and mineral water industry. They are doing product extension as well (ex. Diet Pepsi, Coke Zero etc.) to remain competitive in the market. The definition of classic soft drink can be expressed as follows: Sometimes soft drink may contain alcohol but the within the limit of 0.5%. The carbonated water is made in two ways. It is either using soda siphon or by home carbonation system. The latter one is made by putting dry ice on water. In modern industry, carbondioxide is used instead of dry ice. The carbondioxide is pressured and mixed with water with high pressure. The type of soft drinks decide the addition of colour and customised flavours which distinggishes one from another. The soft drinks can be categories in the following way: Figure 3 Classification of Soft Drinks Market Analysis The market volume of soft drink industry in India in 2013 was 11,755 liters, showing a growth of 170% compared to 4369 liters in 2008. As far as predicted growth rate is concerned, market is showing around 19% growth annually. For product wise analysis, it shows that 20% annual growth rate for next year five in bottled water while the carbonated drink shows. The same figure for juice is 21%. Interestingly, the annual growth rate of carbonated drink is only 10%. This increment will come from mostly due to penetration in rural market while there is considerable decrement in sales in urban area. But if we put the percentage growth, then juice shows more than 100% growth. Market characteristics and major players The soft drink industry market can be analysed using three economic factors. These are market size, growth rate and overall profitability. As compared to hard drink, soft drink contains a share of around 48% in no-alcoholic industry. But the as discussed earlier, the market of carbonated soft drink is shrinking due to the awareness of people for their health. Figure 6 Change in consumer behaviour toward non-alcoholic drinks The above graph is an example that how the consumer’s mindset has been changed from taste to health. It is to observe that sport drinks and bottled water have seen around 40% of growth whereas packet juice along with carbonated soft drink have faced a sharp decline even upto 20%. For example, if the sales of the largest leader is considered then a tentative area-wise sales’ trend is as follows: Figure 7 year-wise change in sales of Coke in different areas From the chart it is evident the increment in sales in year 2010 and 2011 were a world-wide event. But in a growing world like Europe and North America, the sales of Coke is decreasing for last two years. In other side, Pacific and Latin America are showing positive % change of sales over previous year. This discrepancy between growing world and grown world is mostly due to difference in level of education, crave of foreign money by growing world, socio-political difference. Evidently, the soft drink companies are depending mostly on third world market for increment of sales of their original products. Market characteristics and major players The driver for most downstream operations in the soft drink industry is the syrup production. Thus, the CSD industry is largely dependent on the syrup producer. The product life cycle for soft drinks moves as follows: Figure 8 Soft Drinks Industry Supply Chain Market analysis The top three brands in the soft drink industry had a 35 percent share of the market in 2011, According to the latest report from IBIS World. This industry is fiercely competitive. Small companies must conduct soft drink market research competitor analysis to know their current positions in the marketplace. These types of data help small organizations know which strategies are best for their products. Soft drink producers or distributors are not just competing with other soft drink manufacturers. They also must consider competitors in the functional soft drink sector, which includes sports drinks and health-oriented drinks. Figure 9 Soft Drinks industry market share Despite being the world’s two weakest performing regions in 2008, Western Europe and North America continue to hold the maximum revenue for soft drinks industry in the world. Together, they account for over half the total sales of the industry. This shows one of the major strategic problems faced by soft drinks companies globally – while second and third tier markets are showing a steeper growth curve in terms of revenue, their total market share remains small relative to developed markets. Figure 10 Soft Drinks by region Critically, the industry needs to continue investments in high-yield regions of the developed nations and at the same time strengthen their foothold in the emerging market economies. This poses a huge challenge at the time of adverse macroeconomic conditions. Consumer Behaviour Global consumption of soft drinks is said to be rising by around 7% a year, much faster than the growth rate of many other industries. Consumer behaviour for soft drinks is largely volatile and there is very little brand loyalty to be found among consumers. But despite the choices given, a section of consumers tend to stick to one particular choice of CSD. The reason for this has less to do with taste, and more to do with subtle and careful marketing on the part of soft drink makers. The choice of a soda is as much about who you are as what you want to drink. Soda makers calibrate every aspect of their marketing- from their packaging, to their slogans, to the music that plays over their commercials- to create an identity around their products. Porter’s Five Forces Figure 11 Performance of Coke and Pepsi USD $ in millions The above chart shows the quarterly performance of the two biggest companies in this industry. It is evident from this chart that the revenue of Coca-Cola is much lesser than Pepsi, however the former has higher net income. The scale of the revenue generated by these companies gives a glimpse of the huge market. However a new entrant would find it very difficult to enter the market due to the high market share captured by these two companies. The large difference between the revenues and the net income shows the magnitude of the costs involved. Figure 12 Financial Analysis The increasing debt to equity ratio indicates that the biggest players are changing their funding profiles. This would be very difficult for a new firm to replicate. Conclusion From the above analysis, we found that the there was a huge change in the trend of sales of product in Soft Drink industry. We have seen that there were huge sales of traditional soft drinks earlier. But eventually the sales decreased due to rise in consciousness of people about health and increment in number of people suffering from different diseases and obesity which was partially caused by those drink. Big manufacturing companies are doing product extension in energy drink, juice etc or doing product diversification like Chips, snacks etc. The industry has strong entry barriers and the suppliers do not hold much control. The buyers however are very price sensitive and are brand loyal till other factors like taste, content etc. remain constant. References Seth, P. (02.10.2008.). slideshare. In Soft Drink Industry. The predicted value was statistically not significant from the observed value, 16 ml/kg/min. Questions   Was the estimated VO2max from the submaximal exercise significantly (more than 5 ml/kg/min) different from the measured at the end of the max test? What are some possible reasons for the difference? The estimated VO2 max from the submaximal test was 35.7 ml/kg/min, and the measured VO2 max was 52.1 ml/kg/min on the gold standard, and it is statistically not significant from the estimated VO2 value of 16.4 ml/kg/min. One possible reason can mean that the predicted heart rate during the test, 180 beats per minute, was not near the actual max heart rate of 192 beats per minute. Are there any assumptions that you are familiar of that you think that they have been or have not been met during the submaximal exercise test? One assumption that was not met during the submaximal is that the male college students steady state heart rate was not measured during the test at each exercise work rate after three-minute increments. Also, the difference between the actual heart rate of 192 beats per minute and 180 beats per minute is not minimal. Lastly, I was not aware if the participant took any medication, consumed high caffeine such as coffee or soda, was ill, and possibly stressed within the last week which may have altered his heart rate. Some assumptions that were met during the submaximal test were that there was a linear relationship between heart rate and work rate. The mechanical efficiency is the same for everyone because the participant was biking normally with his arms. What are the reasons that you might choose a submaximal exercise test over a maximal exercise test and vice versa? Provide at least three advantages and disadvantages. A submaximal and maximal test can be performed on either a treadmill or a cycle ergometer. A treadmill test is used to the exam for either running or walking, which requires no experience for participants. Be sure to consider your limitations as well. For example, if you recently suffered a heart attack and are obese, this may not be an option for you, and you must get cleared by your primary care provider. A cycle ergometer is one of the more common tests that individuals use that requires no specialized training at all, and the activity is not weight bearing. However, you need someone to administer the test for you. Submaximal tests will help indicate the level of oxygen consumption, the measure of aerobic fitness, and the record of your heart rate response during bouts of an exercise. As intensity increases, your heart rate will increase as well. According to ACE (American Council of Exercise), one single session of exercise can provide an excellent representation to indicate your current state of fitness without the use of expensive equipment or technology. Also, the submaximal test can track your progress over time through a consistent workout program. This inexpensive test is prescribed most commonly by clinicians to help diagnose cardiovascular disease (CAD). If you want to calculate, your maximal heart rate, use the formula 220 Age. Some disadvantages are that the small measurement can allow discrepancies in the results. A maximal test would be used to measure the direct oxygen consumption and maximum heart rate and the amount of carbon dioxide you expend during the test. Also, your heart rate and blood pressure are being monitored by a technician or by an exercise physiologist, and sometimes a physician to supervise. One disadvantage to this test that it is the high cost of each test, time-consuming, and is used correctly to measure aerobic power in athletes. Which one do you think is more applicable to a clinical population and why? I would recommend using a submaximal test if an individual or client of mine wants to focus on endurance training. I think the submaximal test would be more applicable to people who suffer from cardiovascular disease and those who are not exposed to exercise that often. It would be more appropriate for the individual to know where he or she stands on the fitness spectrum before going straight into a vigorous activity. I can use a treadmill test to increase the elevation and or a bike test to increase resistance. The speed, on the other hand, remains constant throughout the duration of the test and heart rate is continually monitored after every incremental increase. The submaximal test stops when your heart rate reaches 85 percent of your max heart rate and or you feel like you cannot continue anymore.

Street Racing Essay -- Racing Sport Sports Cars Essays

Street Racing   Ã‚  Ã‚  Ã‚   The intricacies that are involved in turning a regular car into a â€Å"Street Racer† are many; and racers pour their souls into these magnificent machines. After seeing â€Å"the Fast and the Furious† many people have or wanted to become involved in street racing. They do not realize that this is a sport that takes knowledge, hard work, and nerve. Many of these racers have spent their lives under a car, learning the trade and improving upon it. As I have learned, this is not just a hobby; it is a way of life. This lifestyle does carry a price, racers face persecution from police and the general public. They have their cars impounded and defaced by those who reject racing. Having a racer is not illegal, but some of the things people do with them are. This is what the general public does not understand. The IRA* is a legal racing circuit that embraces Street Racers. It gives the much-needed outlet to build magnificent cars and race them legally. Police are not the only worry on a racers mind. Death, fraud, and theft are the dark side of this moon. Some racers lack legitimate funds for equipment, and they resort to theft and fraud. This is where the misconceptions of the general public resonate. Yes there is crime; and laws are broken, but in everything there is a good and bad. So I warn anyone who pursues this life, enjoy the good, and be ready for the bad. What drives these racers to this lifestyle? They have an addiction to speed. The six-cylinder engine fuels this â€Å"need for speed.† Some may think that their two hundred thousand dollar car is fast, with these engine modifications will have an Accord blowing the doors off a Ferrari. The six-cylinder engine has six pistons pumping in six cylinders; hence, the name. Fuel is injected and burned; causing gas compression (picture a shaken soda bottle). This compression forces the pistons up and down that move your car. With compression in the cylinder, the Turbo comes into play. If two balloons were filled with air, one half and the other full, which would go faster? This is the job of the Turbo. Burning requires air, and when you introduce more air a fire is larger and hotter. It forces compressed air into the engine, letting it burn more air each time the pistons pump increasing boost**. There is a drawback to more air, more heat in the engine. Heat in the engine makes the air d... ...d slows, this is how the spoiler helps. To add more push to the back of the car, the angle and height of the spoiler is increased. This is why some normal cars have little spoiler for show and racers use them for performance. There is a problem to adding all of these parts to a car, weight. As I have said the racers have adapted to this problem. They have lightened their cars by using carbon-fiber** parts.4 They are strong and half as light at metal, so racers can add these parts and not get dragged down†¦literally.   Ã‚  Ã‚  Ã‚  Ã‚   A warning to those who read this, do not get dragged down into the dark side of racing. Racing on streets is dangerous. If you enhance a car like this, it should be raced only on a legal strip. A ten-second rush is not worth killing yourself or others. Work hard and be fair. If you do this you will always win. I hope to have helped any curious person who wanted to know how people make these racers. I wanted to dispel the stereotypes of racers and their lifestyle. Yes, some of this lifestyle is dark; but most racers are kids who love cars. They whole-heartedly adopt the dogma that, â€Å"Nothing else matters, and for those ten seconds or less†¦ they’re free.† 5

Play activity for children Essay

Play is an essential part of every child’s life and is vital for the enjoyment of childhood and as well as social, emotional, intellectual and physical development. Having the time and space to play allows children the chance to keep them physically active and it gives them the freedom to make their own choices about what they want to do. Research shows that play has a range of benefits to the child, family, and the community, as well as improving healthy and quality of life. Play also helps the child improve their self-esteem, self-awareness and self-respect, it gives child a chance to mix with others and develop new skills. Playing can help Manshu with her potty training, such as role-play with dolls could help Manshu understand all about what potty training involves. It could also make the child become much more relaxed about this step in life. For Jessica play (role-play with dolls) could help her understand all about her baby sister and what is happening in the changes at home in her life. Whilst children are in my care I will do my best to offer a range of activities for children to participate in, I will also allow children to give a choice in which activities that the want to participate in, as this will allow the child to become more independent. I feel that it is important for children to be encouraged to do as many activities as possible rather the same thing all the time. By rotating the toys that you have out available for the children to play with it means that they will be learning through play on a range of toys rather than being able to play with the same toys all the time. I think that i t is important that children learn about different cultures and that not all people have the same abilities, children can also learn about these topics through play using ethnic dolls, puzzles, books, art and crafts and cooking food from different cultures. This means having materials, toys, resources in your setting that reflect the diversity of our society. Thus play can help Manshu with her potty training, such as role-play with dolls could help Manshu understand all about what potty training involves. It could also make the child become much more relaxed about this step in life. For Jessica’s play (role-play with dolls) could help her understand all about her baby sister and what is happening in the changes at home in her life. Domestic routines that children can be involved in and how this supports their learning: Activity How can this benefit the child Helping to prepare snacks/food Helps children develop a good understanding of hygiene practices which helps develop personal, social & cognitive development. Using tools (suitable for children) to cut/prepare the food/snacks helps their sensory development and also builds their physical development. Setting the table at meal times This will help develop their independence, it also helps them to learn to follow instruction helping their language skills, matching children’s place mats to their cups & plates can also help learn matching skills, helping their cognitive development. Children could help to tidy up which would develop their social & emotional development. I would make a game out of this & count the things they pick up, helping their mathematic development. Hanging clothes on the line This will help their understanding of how the wind and heat dry things and how we use water for things and not others. Games can also be made of if this using the colours of clothing and pegs etc. Messy Play with Household items e.g. shaving foam, water Messy play encourages children to use their imagination and be creative which helps build self-confidence and self-esteem. Tidying up Children could help to tidy up which would develop their social & emotional development; I would make a game out of this & count the things they pick up, helping their mathematic development. Getting ready for the school run/going out Getting ready to go out children can learn about different body parts as they put on their coast, wellies etc. Then when outside you can help the child’s knowledge & understanding of the world. Climbing & playing on outdoor equipment helps a child’s physical development & co-ordination. It is easy to think about what learning can be achieved from a particular activity but I am aware that some activities may include potential weaknesses for some children, for example ‘preparing snacks and food’ and ‘setting the table’ will not be suitable for younger children in the same way that older children would not benefit from a ‘messy play activity’ which is why having a variety of activities the children can participate in on a daily basis is paramount to their learning. Through observing and keeping a written record of observations of children at play, is a way for you to learn how the child learns, what they enjoy, the development stage they are at and how to plan activities for that child. As children learn through play, when you observe them at play, you will learn the stage they are at, and this will allow you to plan for them individually. You will also learn what kind of learner the child is. Keeping a record of a child’s development is very important, so you can recognise if they are advancing or maybe falling behind some early learning goals. Observations are a great way of sharing information with parents too. Keeping observations will allow you to plan efficiently for each child, knowing where to focus some learning and for you to plan different challenges for the child to allow them to progress. Keeping a learning journal and incorporating your observations into this along with pictures and pieces of the child’s work, will a llow you to keep a good chronological diary of the child’s progress, and make planning run smoothly and well. Children need to be treated as individuals, equally and with respect. The children’s act 2004, has the requirement to treat all children as individuals, and with equal concern. Every single child is different, will enjoy different activities, dislike different activities, and have their own way of learning, through play, and other activities. It is the responsibility of the child carer to ensure they cater for each and every individual need. To do this effectively, you will need to plan for each child, taking observations, and get to know the children in your care well. Everyone that comes to your setting should be welcomed and respected, their beliefs and interests respected as well as their personalities, needs, values, abilities and interests. It is essential that you do not discriminate for any reason, and offer an inclusive environment, and cater and treat everyone equally. Meeting the individual needs of every child is so important, as this ensures they are receiving the best possible care, their rights are being met, opportunities, and an environment that lets them grow and learn at their own pace, securely, safely and happily. The rights of every child are paramount in childcare, when you acknowledge the rights and individuality of every child, you can offer an inclusive setting, where everyone is treated equally and with respect. The best interests of the child must be the primary consideration in all activities concerning the child, and children have the right to be protected from all forms of discrimination. Drop-in sessions can be invaluable in providing support and an opportunity to share ideas, good practice and resources. Planning special days out with the children to the park, museums, libraries etc. can help a child’s development. You could take a camera & let the children take photos, making a storybook all about your day. Meeting up with other childminders for picnics and other days out can help the children form new friendships & help you learn and develop by discussing different ways of play. Other forms of play you could do at home are ‘keep fit’ session, there are a lot of cd/DVDs out there that are made for kids & adults to do, children will find this lots of fun & will help develop their physical development. Whether the day is spent inside or out it should be both fun and informative for the  children and offer a variety in their learning. Although routine is great for children at times it may benefit the children for me to slightly change the routine for example whilst Manshu is potty training I may decide not to attend childminder drop-in or any other sessions to stay at home and develop her potty training in my home, once competent I would reintroduce the outings. Another example of when I might need to slightly alter a routine is if a child becomes unwell and is waiting to be collected early the other child(ren) may need to sacrifice their outing/activity to ensure that the unwell child is safe and comfortable until collected. Regardless of the activity I always adhere to The United Nations Convention on the Rights of the child act which was drawn up in 1989. The act consists of 54 articles stating that all children must be shown respect and that their well- being is the principle factor. The three main areas of this act include:  · Provision (access to food, clean water, housing, education, healthcare etc.)  · Protection (being safe from abuse and discrimination.)  · Participation (having their views heard and participating in making decisions.)
